All electronic mail, e-mail, and other electronic or digital  transmissions (collectively “e-mail”), along with any accompanying documents or attachments, may contain information from this law firm which are confidential, and/or legally privileged.  Such information transmitted by e-mail is based on a reasonable expectation of privacy consistent with ABA Formal Opinion No. 99-413.  No claim of confidentiality and/or legal privilege is waived, and all rights thereto are hereby reserved and continue to be asserted. 


The information transmitted by e-mail is intended only for the use of the individual or entity named as the recipient.  If one receives an e-mail but is not the intended recipient, such party or parties are hereby notified that:  any disclosure, review, copying, distribution, interception, re-transmission, dissemination, or the taking of any action in reliance on the contents of the transmitted information is strictly prohibited; further, the e-mail, document and materials should be returned to this law firm immediately, and the records of such materials should be deleted and destroyed.  If an electronic mail, e-mail, or other electronic or digital  transmission is received but in error, please notify this firm immediately.  This firm reserves the right to monitor and retain all incoming and outgoing communications as permitted by applicable law.

Any e-mail or writing appearing to be from the law firm of Kenneth B. Lerman, P. C. which requests a wire or other transfer of funds to any party, must be double verified.  The request and any corresponding instructions must be confirmed personally via telephone with attorney Lerman before the initiation of any wire or other transfer; only call this firm’s established telephone number, and verify you are speaking with only attorney Lerman.  It is the responsibility of any person wiring funds to evaluate and verify that the recipient is the intended and lawful recipient.  Hackers are targeting e-mails, websites, and communications of law firms and other businesses in attempts to initiate fraudulent wire or other transfer requests.  CONFIRM BY CALLING THE ORIGINATOR OF THE EMAIL, USING PREVIOUSLY KNOWN CONTACT INFORMATION, PRIOR TO WIRING OR OTHERWISE TRANSFERRING FUNDS.


E-mails and other transmissions over the Internet not encrypted cannot be guaranteed to be secure or error-free as information could be intercepted, corrupted, lost, destroyed, improperly modified, arrive late or incomplete, or contain viruses.  Beware of "Phishing" schemes.  This firm will never send an unsecure message that asks to "click" on a link without direct conversation.   Any such message is NOT from this firm.   This firm takes measures to ensure that each electronic mail, e-mail, or other electronic or digital  transmission is virus free.  No responsibility is accepted by Kenneth B. Lerman, P.C. or its principal for any loss or damage arising in any way from its use.   It is the responsibility of any recipient to evaluate and verify each electronic mail, e-mail, or other electronic or digital  transmission it receives from this law firm is free of any and all viruses or digital programming problems. 


Do NOT send any instruments, copies, PDFs, files, documents, emails, lists, or other writings containing social security numbers, driver’s license numbers or other personal identifying information by unsecure email or electronic transmission.  Please send such materials by U.S. mail or through a secure, encrypted file sharing service so they cannot be intercepted, misused, and abused by unauthorized third-parties seeking to defraud.
